01Who We Are & Scope

This Privacy Policy is issued by Act Bold Media Group, LLC, a Florida limited liability company doing business as Act Bold Digital Marketing ("Act Bold," "we," "us," or "our"), headquartered at 125 NE 32nd Street, Suite E1, Miami, FL 33137, with an additional office at 5901 W. Century Blvd, Suite 1004, Los Angeles, CA 90045.

It applies to personal information we collect through actbold.com, including the ActBold AI section at actbold.com/ai, and through related communications such as email, phone calls, and consultations booked through this site (together, the "Site"). It does not cover data we process on behalf of clients under a services agreement — that processing is governed by the applicable client contract.

02Information We Collect

Information you provide directly

  • Contact and inquiry forms: name, email address, phone number, company or website URL, and any message or project details you include.
  • Consultation bookings: name, email address, company name, company size, meeting topic or notes, and your selected date, time, and time zone.
  • Newsletter signups: email address.
  • Career applications: name, contact details, links you share (portfolio, LinkedIn), and information about your experience and qualifications.
  • Correspondence: the contents of emails, calls, or messages you exchange with us.

Information collected automatically

  • Device and usage data: IP address, browser type, operating system, device type, referring URLs, pages viewed, time spent on pages, and interactions with the Site.
  • Approximate location: city- or region-level location inferred from your IP address.
  • Cookies and similar identifiers: described in the Cookies section below.
  • Server logs and security data: we log IP addresses for security purposes, including rate-limiting of form submissions to prevent abuse.

03How We Use Information

  • To respond to your inquiries and provide requested information or proposals.
  • To schedule, confirm, and conduct consultations and audits you book.
  • To provide, maintain, secure, and improve the Site and our services.
  • To send marketing communications you have requested or that we may lawfully send, with the ability to opt out at any time.
  • To measure Site performance and understand how visitors use the Site (analytics).
  • To run, measure, and improve our advertising on platforms such as Google and Meta, including conversion measurement and remarketing.
  • To evaluate job applications.
  • To detect, prevent, and address fraud, abuse, and security issues.
  • To comply with legal obligations and enforce our Terms of Service.

04Cookies & Tracking Technologies

Cookies are small text files stored on your device. We and our service providers use cookies, pixels, and similar technologies in the following categories:

  • Essential: required for the Site to function (for example, theme preference and security features). These cannot be switched off through our Site.
  • Analytics: help us understand how the Site is used (Google Analytics 4 — see Section 05).
  • Advertising: used by advertising platforms to measure conversions and show you relevant ads on other sites and apps (Google Ads and Meta — see Section 06).

Most browsers let you refuse or delete cookies through their settings. Blocking some cookies may affect how the Site works. The opt-out tools in Sections 05 and 06 give you additional, platform-specific controls.

05Analytics (Google Analytics 4)

We use Google Analytics 4, a web analytics service provided by Google LLC, to measure how visitors find and use the Site — for example, which pages are viewed, how long visits last, and which marketing channels drive traffic. Google Analytics uses cookies and collects device identifiers, IP-derived approximate location, and usage data. We use this information in aggregate to improve the Site and our marketing.

You can learn how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites and opt out of Google Analytics with the Google Analytics opt-out browser add-on.

06Advertising: Google Ads & Meta (Facebook / Instagram)

We advertise our services on third-party platforms and use those platforms' technologies on the Site to measure and improve our campaigns. This is interest-based (sometimes called "targeted") advertising, and under some state laws it may be considered "sharing" of personal information for cross-context behavioral advertising.

Google Ads

  • Conversion tracking: the Google tag on our Site reports to Google when a visitor who clicked one of our ads completes an action such as submitting a contact form or booking a call, so we can measure ad performance.
  • Remarketing: Google may use cookies or device identifiers to show you our ads on Google Search, YouTube, and partner sites after you visit the Site.
  • Customer Match: we may upload contact information (such as email addresses) to Google in hashed form to reach existing contacts or similar audiences with our ads.

Meta (Facebook and Instagram)

  • Meta advertising tools:we may use the Meta Pixel and Meta's Conversions API to measure ad performance and website actions originating from Facebook and Instagram ads.
  • Custom and Lookalike Audiences:we may create ad audiences from Site visitor activity or from contact lists uploaded to Meta in hashed form, and Meta may use that data to build similar ("lookalike") audiences.

Your advertising choices

  • Google: adssettings.google.com (My Ad Center) to control personalized ads.
  • Meta: Ad Preferences in your Facebook or Instagram settings at facebook.com/adpreferences.
  • Industry opt-outs: optout.aboutads.info (Digital Advertising Alliance) and optout.networkadvertising.org (Network Advertising Initiative).
  • Device settings: iOS and Android provide system-level controls that limit ad tracking across apps.

07How We Share Information

We do not sell personal information for money. We share personal information only as described below:

  • Service providers: vendors that host and operate the Site and our business tools, including cloud hosting (Railway), scheduling (Cal.com, which processes booking details to create your appointment), transactional email delivery (Resend), and analytics and advertising platforms (Google, Meta) as described above. Providers may only use the data to perform services for us.
  • Advertising partners:as described in Section 06, which may constitute "sharing" for cross-context behavioral advertising under California law. You can opt out — see Section 12.
  • Professional advisors: lawyers, accountants, and insurers where reasonably necessary.
  • Legal and safety: to comply with law, legal process, or enforceable government requests, or to protect the rights, safety, and property of Act Bold, our clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.

08Email, Phone & Text Communications

When you submit your contact details through the Site, you agree that we may contact you about your inquiry by email or phone, and by text message where you provide a mobile number. Message and data rates may apply to texts.

Marketing emails always include an unsubscribe link, and you can opt out of marketing calls or texts by replying STOP or telling us at any time. Opting out of marketing does not stop transactional messages, such as booking confirmations for a consultation you scheduled.

09Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy — for example, inquiry and lead records for as long as they are relevant to a potential or actual business relationship, and analytics data for the retention periods configured in our analytics tools. We may retain certain information longer where required for legal, accounting, or dispute purposes. When information is no longer needed, we delete or de-identify it.

10Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted connections (HTTPS), access controls, and rate-limiting to deter abuse. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a breach affecting your personal information, we will notify you as required by applicable law.

11Your Privacy Rights & Choices

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you, and receive a copy.
  • Correct inaccurate personal information.
  • Delete your personal information.
  • Opt out of targeted advertising, or of the "sale" or "sharing" of personal information.
  • Object to or restrict certain processing, or withdraw consent where processing is based on consent.
  • Receive your data in a portable format.

To exercise any of these rights, email privacy@actbold.com with your request. We will verify your identity (typically by confirming control of the email address associated with your data) and respond within the time required by applicable law. You may use an authorized agent where the law allows; we will not discriminate against you for exercising your rights.

12California Residents (CCPA / CPRA)

In the preceding 12 months we have collected the categories of personal information described in Section 02: identifiers (name, email, phone, IP address), commercial information (inquiries and bookings), internet activity (Site usage), approximate geolocation, and professional information (from career applications and business inquiries). We collect them from you directly and from your device, use them for the purposes in Section 03, and disclose them to the recipients in Section 07.

We do not sell personal information for money. Our use of advertising cookies and pixels (Section 06) may be considered "sharing" for cross-context behavioral advertising under the CPRA. You can opt out of that sharing by emailing privacy@actbold.com, using the platform and industry opt-outs in Section 06, or enabling a recognized opt-out preference signal such as Global Privacy Control in your browser, which we honor where required by law. We do not use or disclose sensitive personal information for purposes requiring a "limit" option, and we do not knowingly sell or share the personal information of consumers under 16.

13EEA, UK & International Visitors

The Site is operated from the United States, and information is processed and stored in the United States, where privacy laws may differ from those of your jurisdiction. If you visit from the European Economic Area or the United Kingdom, our legal bases for processing are: performance of a contract or pre-contractual steps (responding to inquiries and bookings), legitimate interests (operating, securing, and marketing our business), consent (where required, such as for certain cookies or marketing), and legal obligation. You may lodge a complaint with your local supervisory authority, but we would appreciate the chance to address your concerns first at privacy@actbold.com.

14Children's Privacy

The Site is a business-to-business service and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, contact us at privacy@actbold.com and we will delete it.

15Third-Party Links

The Site links to third-party websites and platforms (for example, our social profiles and partner sites). Their privacy practices are governed by their own policies, which we encourage you to review. This policy applies only to information collected by Act Bold.

16Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page, and for material changes we will provide more prominent notice on the Site. Your continued use of the Site after an update means the revised policy applies to you.
